The Waste Management Act (Law Number 24/2022) shall be amended as follows:
1. Insert a subsection after Section 25(b) of the aforementioned Act as follows:
25. (c) The Regulation made under subsection (b) shall, with reference to the types of waste specified under this Act, prescribe the license categories, the rules and procedures for the issuance of licenses under each category, and the rules relating to the imposition of additional conditions on such licenses issued under such categories.
2. Insert a subsection after Section 32(b)(3) of the aforementioned Act as follows:
32. (b) (4) A pack or bundle that contains more than 50 (fifty) plastic bags.
3. Insert a section after Section 35 of the aforementioned Act as follows:
35-1. Persons not registered with MIRA
(a) The Ministry shall formulate a Regulation setting out the rules as regards the manner in which the fee imposed under this Act is to be expended by persons other than those registered for GST with MIRA, and the Regulation shall be published in the Government Gazette and on the Ministry’s website before the expiry of 1 (one) year from the date of effect of this Act.
(b)The Ministry shall ensure that persons other than those registered for GST with MIRA collects plastic bag fee throughfrom their business activities, in accordance with this Act and the Regulation made pursuant to this Act.
4. Amend Section 76 (ll) of the aforementioned Act as follows:
76. (ll) “Plastic bag” refers to bags made of plastic (including self-destructing degradable plastic made of oxo-degradable and synthetic polymer) which are used for carrying goods, but does not include plastic bags used as packaging solely to the extent necessary for the sale of those goods.
5. This Act shall commence from the date of its publication in the Government Gazette following its passing and ratification.
